In the upheavals of the real estate recession, mortgagors in debt are especially in need of experience and resolve, especially in the areas of foreclosure and bankruptcy.
There is no easy out from a dilemma such as losing one’s house, having credit ratings ruined after a foreclosure sale, or simply losing a home - even with the safety of a HAMP agreement. Yet, Ms. Axsmith has been able to reverse foreclosures, and in some cases compelling a careless lender to not only halt the illegal foreclosure but to pay damages as well.
Ms. Axsmith helps mortgagors and homeowners stop pending foreclosure proceedings by helping to file Chapter 13 or by obtaining loan modifications or negotiating repayment of mortgage monies owed. In the District of Columbia, a foreclosure is a non-judicial process, accomplished without having to go to court or have a judge look at and evaluate the validity of the foreclosure case.
Filing under Chapter 13 allows you to restructure your debt, although, unlike other bankruptcy arrangements you will have to repay your debts over a period of five years, but will still be able to keep your primary dwelling.
Ms. Axsmith can also help the bank accept a deed in lieu of foreclosure. With this option, the mortgagor turns the property back to the bank, in lieu of having to go through a foreclosure. Sometimes, if no new purchaser will buy the property at the original price, the property is given back to the bank, which is known as a real estate owned property.
When the bank obtains a court ordered termination of a homeowners equitable right of redemption, Ms. Axsmith can help to grant the homeowner the equitable right of redemption if the borrower repays the debt in a reasonable time.
Ms. Axsmith can assist any homeowner to file Chapter 13 as long as the homeowners unsecured debts are less than $360,475 and secured debts are less than $1,081,400. The homeowner cannot file under Chapter 13 if during the preceding six months (180 days) a prior bankruptcy petition was dismissed due to the homeowner’s failure to appear before the court or comply with orders of the court, or was voluntarily dismissed after creditors sought relief from the bankruptcy court to recover property upon which they hold liens.
